Terms of Service
1. Payment and Refund Policies
Payment Due
Full payment is required before services begin. We accept major credit cards, electronic transfers, and other payment methods as specified on our website. Services will not commence until payment has been received and processed.
Refunds
Our refund policy is detailed in our separate Return Policy document. In summary, services are non-refundable once an engagement has started, and subscription services require 30 days' notice prior to the next billing cycle for cancellation.
Late Fees
Payments received after the due date specified in your invoice will incur a late fee of 5% of the outstanding amount, with an additional 1.5% added for each 15-day period thereafter. Late fees will continue to accrue until the full payment, including all accumulated late fees, is received. Unpaid balances may also result in suspension or termination of services without refund.
Unpaid Balances
Accounts with unpaid balances exceeding 60 days may be referred to a collection agency. Client will be responsible for all collection costs, including but not limited to agency fees, attorney fees, court costs, and any other associated expenses. Unpaid balances may also result in suspension or termination of services without refund.
2. Turnaround and Revisions
Draft Delivery Time-frame
Client and Company will determine the project timeline upon initial discussion, which will be documented in project details. Timelines may vary depending on calendar availability for both parties, complexity of the project, and current workload. Any anticipated delays will be communicated to the Client as promptly as possible.
Revision Policy
After initial discussions, a resume or other agreed-upon deliverable will be provided. The service includes two (2) revision rounds at no additional cost. Revision requests must be submitted within seven (7) days of receiving the draft. Additional revision requests beyond the included two rounds will incur fees at our standard hourly rate.
Client Responsibilities
Client is responsible for:
- Providing complete, accurate, and relevant information required for Company to deliver the requested assets
- Booking calendar dates for each engagement through our scheduling system
- Attending all scheduled appointments on time and prepared
- Providing feedback within the specified time-frames.
If more than two (2) appointments are missed without 24-hour advance notice, the Company reserves the right to end the contract early with no refund.
3. Confidentiality and Privacy
Data Protection
We are committed to protecting your personal information. All client information will be kept strictly confidential and will not be shared with third parties without your explicit consent, except as required by law or as necessary to provide our services.
Data Security
We implement reasonable security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. These measures include internal reviews of our data collection, storage, and processing practices and security measures to guard against unauthorized access to systems where we store personal data.
4. Guarantees and Limitations of Liability
No Guarantees
While we strive to provide high-quality services, we do not guarantee job placement, interview invitations, salary increases, or any specific employment outcomes. Our services are advisory in nature, and results vary based on numerous factors outside our control, including market conditions, individual qualifications, and employer preferences.
Limited Liability
Our liability is strictly limited to the amount paid for our services. Under no circumstances shall we be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to lost salary, lost profits, business interruption, negative outcomes, or loss of programs or information.
Client Representations
Client warrants that all information provided is accurate, truthful, and not misleading. Client acknowledges that the Company relies on this information to provide its services, and that inaccurate information may negatively affect outcomes.
5. Intellectual Property
Ownership
Final deliverables (such as resumes, cover letters, LinkedIn profiles) are the property of the Client once payment has been received in full. The Company retains ownership of all preliminary drafts, templates, methodologies, and processes used in creating the deliverables.
Client Usage Rights
Client is granted a non-exclusive, non-transferable license to use the materials provided for personal job-seeking purposes only. Client may not sell, transfer, or distribute the materials to third parties, or use them for commercial purposes without explicit written consent from the Company.
6. Other Important Clauses
Agreement to Terms
By purchasing our services or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you should not use our services.
Policy Updates
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. You are responsible for reviewing these Terms periodically for changes. Your continued use of our services after changes are posted constitutes your acceptance of the modified terms.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Colorado, USA, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located within Douglas County/Highlands Ranch, Colorado/USA.
Entire Agreement
These Terms of Service, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and the Company regarding your use of our services, superseding any prior agreements between you and the Company.
Dispute Resolution
Any dispute arising from these Terms shall first be addressed through informal negotiation. If the dispute cannot be resolved informally, the parties agree to participate in mediation without pursuing legal action. The cost of mediation shall be shared equally between the parties.
User Responsibilities
Users are prohibited from:
- Providing false or misleading information
- Attempting unauthorized access to our systems
- Using our services for unlawful purposes
- Engaging in any activity that disrupts or interferes with our services
- Harassing, threatening, or abusing our staff
Violation of these prohibitions may result in immediate termination of services without refund.
Testimonials and Reviews
At the conclusion of our engagement, we may request that you provide a testimonial regarding your experience with our services. By agreeing to these Terms of Service, you grant us permission to:
- Request a testimonial or review upon completion of services
- Use your testimonial, first name, and last initial (or full name with your explicit permission) in our marketing materials, website, social media, and other promotional channels
- Edit testimonials for length, grammar, or clarity while maintaining the original sentiment
You maintain the right to:
- Decline to provide a testimonial without penalty
- Request removal of your testimonial from our materials at any time by contacting us in writing
- Review and approve any edited version of your testimonial before publication
We will never share your contact information or other personal details alongside testimonials without your explicit written consent.
By using our services, you acknowledge that you have read, understood, and agree to these Terms of Service.
